The Supreme Court on Thursday partly struck down controversial Section 377 and decriminalised consensual adult sex between gay couple. Supreme Court referred the concerned section of IPC as “irration, arbitrary and incomprehensible” and passed the historic 493 pages judgement.
A wave of happiness and joy can be seen in the country. LGBTQ community is celebrating their victory following the apex court’s judgement.
This decision will empowers the community to enjoy equal constitutional status as other citizens and also affirms their right to claim “the right to adopt, marry and have a family”.
The judgement was made by a five-judge bench comprising of Chief Justice of India, Deepak Mishra, Justice AM Khanwilkar, Justice DY Chandrachud, Justice Indu Malhotra and Justice R F Nariman.
Chief Justice while reading the supreme court order said, “”Sustenance of identity is the pyramid of life. No one can escape from their individualism.”
The section 377 of IPC was a British colonial law made in 1861. This section not only acknowledged the LGBTQ community but also did not let them enjoy their fundamental rights.
